PRODUCT WARRANTY & SAFETY POLICY
This Limited Product Warranty and Safety Policy is given by Periti Industries Pvt. Ltd. in respect of the TermiPore Anti Termite Reticulation System (TermiPore ATRS) and related accessories purchased through www.termipore.com and www.buy.termipore.com. It forms part of, and should be read together with, the Website Terms & Conditions and the Selling, Shipping & Returns Policy, each published separately on the Website. It applies in addition to, and does not exclude, any right or remedy available to a consumer under the Consumer Protection Act, 2019.
1. What is Covered — Warranty Against Structural Defect Only
This Warranty covers structural or physical failure of the pipe arising from a defect in material or workmanship, and nothing else.
“Manufacturing Defect” means: a structural or physical failure of the pipe — such as cracking, splitting, breaking, or other loss of structural integrity — occurring under normal load and soil conditions, where the failure is shown to originate from the material or manufacturing process, and not from installation, handling, modification, or external damage.
2. Warranty Period
The warranty period against manufacturing defect is defined in the installation manual and updated from time to time. This period is from the date of installation, as recorded on the installation completion certificate, or from the date of invoice if no installation certificate is furnished. This period applies subject to Clause 4 below (Installation Timing and Pre-Installation Inspection), including the requirement that any defect visible before installation must be reported to Us before the Product is installed or concealed.
3. CONDITION OF WARRANTY AGAINST MANUFACTURING DEFECT — PROFESSIONAL INSTALLATION REQUIRED.
This Warranty is valid only where the Product has been installed, commissioned and put into use by an Authorised Installer (a pest control operator, contractor or technician trained or recognised by Us, or with demonstrable documented competence in termite reticulation installation), strictly in accordance with the latest version of Our installation manual, drawings and technical guidance published on Our website and official social media pages from time to time, and where an installation completion record (photographs and/or a signed checklist) is available on request. Installation by an unqualified person, or any deviation from Our installation specifications — including incorrect jointing, unauthorised cutting/modification of the pipe, improper backfilling, or failure to pressure-test the reticulation network before concealment — will void this Warranty in respect of the affected section of the Product, and any consequent damage or failure will not be treated as a Manufacturing Defect. You and Your Authorised Installer are responsible for checking and following the latest published version of Our installation guidance before commencing installation. You are responsible for engaging and paying for the Authorised Installer, and for retaining the installation completion record; where the Product was supplied to a contractor or pest control operator for installation at a third-party site, that party should ensure the end-user/site owner is informed of this requirement. This condition is also a term of sale under the Website Terms & Conditions
4. Installation Timing and Pre-Installation Inspection
(a) Installation within 6 months: The Product must be installed within 6 (six) months from the date of purchase/invoice. If the Product is installed after this period, We may, at Our discretion, decline to honour this Warranty in respect of that Product, since prolonged storage before installation is outside Our control and may affect the Product's condition.
(b) Pre-installation inspection and notification: Before installing the Product, You and Your Authorised Installer must visually inspect it and notify Us immediately, and in any event before the Product is installed or concealed, of any visible or apparent defect. Any defect that was visible or apparent on reasonable inspection before installation, but where the Product was nonetheless installed, concealed or put into use without notifying Us, will not be covered under this Warranty.
5. Product Safety and Handling Disclaimer
(a) Scope of supply — no chemical supplied by Us: We manufacture and supply only the physical TermiPore reticulation pipe/hardware system. We do not manufacture, formulate, supply, sell or recommend any specific termiticide or other pesticide chemical for use with the Product.
(b) Chemical selection and handling is Your responsibility: Where a termiticide or other pre-construction/soil treatment chemical is used together with the Product, You and Your Authorised Installer/pest control operator are solely responsible for (i) selecting a termiticide that is registered and approved for use in India under the Insecticides Act, 1968 and the rules made thereunder by the Central Insecticides Board & Registration Committee (CIB&RC), and (ii) strictly following that chemical manufacturer's own product label, Safety Data Sheet (SDS)/Material Safety Data Sheet (MSDS), recommended dosage, application method, and statutory storage, transport, handling and disposal requirements.
(c) No liability for third-party chemicals: We accept no responsibility or liability for the selection, registration status, quality, handling, application, dosage, or any toxicological, environmental, health or safety consequence arising from any termiticide or other chemical used in conjunction with the Product. Any question about a chemical's hazard classification, exposure risk, first-aid measures or safe handling must be directed to that chemical's manufacturer or supplier, and not to Us.
(d) Hazards specific to installing the pipe/hardware system: Cutting, jointing and, where applicable, solvent-welding of PVC/uPVC pipework can involve sharp edges, dust, and adhesives/solvent cement that release fumes. The Authorised Installer must use appropriate personal protective equipment, including cut-resistant gloves and safety eyewear, must ensure adequate ventilation when using any adhesive or solvent cement, and must follow that adhesive's own manufacturer label/SDS instructions, which We do not provide and are not responsible for.
(e) Site and excavation safety: Installation typically involves excavation or trenching around foundations and sub-structure works. The Authorised Installer and the principal contractor at the site are responsible for compliance with applicable building, excavation and occupational health and safety requirements, including trench safety, shoring where necessary, and checking for underground utilities before digging. We do not supervise or control site works and accept no liability arising from them.
6. Other Exclusions — Not Treated as a Manufacturing Defect
None of the following is treated as a Manufacturing Defect, and each is excluded from this Warranty:
• Damage caused by misuse, accident, structural movement/settlement not attributable to the Product, fire, flood, pest or insect activity, or any other cause beyond Our control;
• Normal wear and tear, discolouration, or cosmetic variation that does not affect function;
• Use of the Product for any purpose other than as an anti-termite reticulation/barrier system as described in Our literature;
• Modification, alteration or repair of the Product by anyone other than Us or an Authorised Installer acting on Our instructions;
• Use of third-party fittings, adhesives, termiticides or accessories not approved by Us in combination with the Product;
• Failure to provide Us with reasonable access to inspect the installation, or to return the Product/a sample for testing, when requested in connection with a claim;
• Any consequential loss, including the cost of re-excavation, re-flooring, alternative pest treatment, or loss of use of the premises.
7. How to Make a Claim
To make a warranty claim, write to Us at the email address below within [INSERT NUMBER] days of becoming aware of the suspected Manufacturing Defect, providing: (a) proof of purchase/invoice; (b) the installation completion certificate/checklist and photographs referred to in Clause 3 above; (c) clear photographs or video of the suspected defect; and (d) a description of the issue. Because this Warranty covers Manufacturing Defects only, We may, at Our discretion, require a site inspection (which You agree to facilitate) and/or require the affected Product, or a representative sample, to be returned to Us at Your cost for inspection and, where necessary, material testing, to determine whether the cause is a Manufacturing Defect as defined in Clause 1 before any claim is accepted. No Product should be removed, cut open, or further concealed once a defect is suspected, without Our prior written consent, failing which We may decline the claim.
8. Remedy
Where a claim is accepted, We will, at Our sole discretion, either replace the Product found to have a Manufacturing Defect with the same or an equivalent product, or issue a credit/refund limited to the price paid for the affected Product. Because the Product is installed as a permanent, embedded part of the structure, We do not offer repair as a remedy. This is Your sole and exclusive remedy under this Warranty.
Our obligation under this Warranty extends only to the quantity of Product proven, to Our reasonable satisfaction, to be defective, and not to the entire quantity of Product supplied to You or installed at the site. Where You contend that a defect is attributable to a manufacturing batch or lot common to other units supplied under the same Order, You must demonstrate this to Our satisfaction, including by reference to batch/lot identification and the nature of the defect; We may, but are not obliged to, extend the remedy to that batch or lot if We agree, following Our own inspection, that the defect is systemic rather than confined to the unit(s) proven defective.
We are not responsible for the cost of removal, re-installation, civil works, flooring or finishing associated with accessing or replacing the Product, unless expressly agreed by Us in writing.
9. Transferability
This Warranty is extended to the original purchaser of record and, where the Product was purchased by a contractor/installer for a named end-client, to that end-client, provided the installation completion record under Clause 3 identifies the installation site and is produced with the claim. The Warranty is not transferable on resale of the property without notice to and written acknowledgement by Us.
10. Relationship with the Website Terms & Conditions
This Policy is subject to the Limitation of Liability, Governing Law and Dispute Resolution provisions of the Website Terms & Conditions, which apply equally to claims made under this Policy.
